1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Predictboard governing your use of the website at predictionmarkets.exchange and any related services (collectively, the "Service"). By creating an account, accessing the website, or using any feature of the Service, you confirm that you have read, understood, and agree to these Terms.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Effective date" above and, where appropriate, notifying registered users by email. Your continued use of the Service after any modification constitutes acceptance of the updated Terms.

2. Description of Service

Predictboard is a data aggregation and analytics platform that collects, normalises, and displays real-time probability data from third-party regulated prediction market exchanges (collectively, "Data Sources").

The Service includes: real-time market data display, cross-platform price comparison, educational content, probability card generation, and (for Pro subscribers) alerts, watchlists, and data export.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms in your jurisdiction.

Access to the Service may be restricted in certain jurisdictions. You are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you in your location. We make no representation that the Service is appropriate or available for use in any particular jurisdiction.

4. User Accounts

4.1 Account creation

To access certain features (watchlists, alerts, data export), you must create an account. You agree to provide accurate, current, and complete information during registration and to update it to keep it accurate.

4.2 Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@predictionmarkets.exchange if you suspect unauthorised access to your account.

4.3 Account termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason we deem appropriate. You may delete your account at any time through your account settings.

5. Subscriptions and Billing

5.1 Free tier

The Explorer (free) tier is available without payment and provides access to core features as described on our Pricing page. We reserve the right to modify free tier features at any time with reasonable notice.

5.2 Paid subscriptions

Pro and Institutional subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorise us to charge your payment method for the applicable fees. All fees are in US dollars unless otherwise stated.

5.3 Cancellation and refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by applicable law.

5.4 Price changes

We reserve the right to change subscription prices with at least 30 days' notice to affected subscribers. Continued use after the effective date of a price change constitutes acceptance of the new price.

6. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Scrape, crawl, or systematically extract data from the Service without our prior written consent
• Attempt to circumvent any access controls, rate limits, or security measures
• Use the Service to manipulate prediction market prices or engage in market manipulation
• Resell, redistribute, or commercially exploit our data without a valid Institutional licence
• Impersonate any person or entity or misrepresent your affiliation
• Introduce malware, viruses, or any malicious code
• Use automated tools to access the Service in a manner that places excessive load on our infrastructure

7. Intellectual Property

The Service, including all software, design, text, graphics, and the compilation of content (excluding data sourced from third-party exchanges), is owned by Predictboard and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes. The Service may be used to generate embeddable cards and widgets; such outputs may be used subject to attribution requirements (predictionmarkets.exchange must be credited).

Market probability data displayed on the Service is sourced from connected exchanges under their respective API terms. This data remains the property of the relevant exchange.

8. Third-Party Data and Services

The Service aggregates data from regulated prediction market exchanges via their public APIs. Predictboard is not affiliated with, endorsed by, or officially partnered with any exchange.

Data accuracy: While we make reasonable efforts to ensure accuracy, we cannot guarantee that data sourced from third parties is free from errors, delays, or omissions. You acknowledge that prediction market data may be delayed, inaccurate, or incomplete, and that you should verify prices on the relevant platform before making trading decisions.

The Service may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusion of certain warranties or limitations on liability; in such cases, the above limitations apply to the maximum extent permitted by law.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Predictboard is incorporated, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
